Julian Silverman - Barnet campaigner RIP

Today I received sad news that Julian Silverman had passed away on Boxing Day. Julian may not so well known outside Barnet, but he was amongst the activist community here in Barnet. Julian one of the key people who organised and set up Barnet Alliance for Public Services (BAPS).

I was present when Julian came up with the statement above which summed up what we were all about.

It seemed ambitious but back then we had a real energy in our community and no obstacle was too big.

It would be fair to say, Julian was very political and craved political debate over the issues we were fighting. He never missed an opportunity to try to engage with the Tory politicians who were hell bent on outsourcing all of the Council services. He knew he was unlikely to succeed but he did it anyway. I sat in many public council meeting where he took up his right to address council committees. Julian lived and breathed activism and was always ready to take up a campaign in his community. He was heavily involved in some of the housing campaigns particularly in West Hendon.

I hadn't known he was unwell until recently and I had been told he was on the mend.

I am glad and proud to have been able to work with Julian.

We need more comrades like Julian, who do more than just talk about activism, they just get on with it.

Support Derby City TAs and Unisongate update

On my way to ‪#Unisongate Day Two ‬for Cross examination of UNISON witnesses.

I want to take this opportunity to remember what is important and at the heart of everything I believe grassroots organisations should be about.

Derby City Council Teaching Assistants have been taking strike action against a massive cut in salary imposed by a Labour Council which to date has taken an adversarial approach to any attempt to address this injustice.

I heard similar stories in Durham.

What is going on in our society when an employer thinks they can impose such a life threatening pay cut on low paid workers.

For me this is a reason why grassroots trade unions are still needed. The mainstream union movement needs to radically change. The politics and tactics of appeasement are not working and I'd argue they never would. The challenge has to be to mobilise and build an active fighting resilient trade union movement that inspires members to get involved and tackle the worrying increase in inequalities both with our communities but our workplaces.

I have made a lot of messages of support for the Durham TAs campaign, and I would to help if possible to help the Derby City TAs. They are striking and it is likely to continue next term.

I am asking all my friends comrades supporters to send solidarity messages to Derby City Unison branch.

We must stay with them until they win as we are going to do for the Durham TAs.

Yesterday I heard many bad things at Unisongate hearing and I no doubt will hear more today. I learnt a comrade had been threatened by union lawyers for libel. My view is this is unacceptable, we badly need union resources allocated to grassroots union branches so they can swiftly support members in the workplace. We also need trade union reps who are not going to look away when they see something wrong. What use is a rep if they don't speak out when they see injustice. Grassroots reps risk their employment every time they speak up for members. It is a risk with being a rep, but if we are a strong union the risk of attack by employer is low. Sadly employers at the moment are only afraid of a few unions not all.

So with a heavy heart I make my way to the Employment Appeal Tribunal, but with an even stronger determination to continue to build and organise workers where ever I am.

BreakingNews: “UNISON: Union democracy on trial.” #Unisongate



On Monday 19 December UNISON the Trade Union with 1.3 million members is on trial facing serious allegations about the running of the election campaign that saw Dave Prentis elected general secretary of Britain’s largest public sector union, Unison last year.

The complainants allege that Unison breached its rules and the 1992 Act in relation to the election for the position of General Secretary of UNISON in late 2015.

The Hearing begins Monday 19 December to Wednesday 21 December (10am) inclusive and it is being held at:

Employment Appeal Tribunal, Fleetbank House, LONDON, EC4Y 8JX.

The complaints were registered by UNISON members after a whistle-blower provided an audio-tape of paid officials plotting to campaign for Dave Prentis.

The complainants allege:

“The breach occurred at a meeting organised and attended by UNISON officials in the Greater London Region which took place at the UNISON premises known as Congress House and where UNISON staff received a briefing on how to campaign for the re-election of David Prentis.”

The plot thickened when an article regarding campaign “Team Dave” emails were published by Private Eye in February 2016.

“Team Dave; Update No 20 sent at 09.44 on Friday 23 October 2015. States ‘It may be that in some circumstances you may be able to “circumvent” hostile branches by covertly working with sympathetic employer contacts. ….”

If the Assistant Certification Officer were to find against UNISON and make an Enforcement Order to order a re-run of the election then (with the recent announcement that Len McClusky, Unite General Secretary has called an early election next year) there could be two general secretary elections taking place in 2017 affecting more than 3 million trade union members.

4. Whistleblowing tape – 21 October 2015
A damning audio-tape emerged in early December 2015 providing evidence that senior officials of Britain’s biggest public service union, UNISON, had allegedly acted in blatant breach of the union’s own rules to secure the incumbent General Secretary’s re-election. The 23-minute tape appeared on an Anonymous Blog here:

The audio recording largely features the voice of UNISON’s London Regional Secretary, repeatedly thanking paid union officials under her management for their work in securing branch nominations for the three-term incumbent UNISON General Secretary, Dave Prentis.

“We have done very well and I want to thank everybody and congratulate them on getting the nominations that they have got. This is a list of the Greater London branch nominations for Dave Prentis the deadline closed last Friday, I do not have a list of the other candidates, and that will appear in due course but I haven’t got it. But we have done very well, we’ve got almost 50 nominations here so that is excellent and thanks very much, er Dave is very very pleased and he has related that to me personally er it is very important because obviously this is going to be a hard fought election.”

The recording includes derogatory references to Mr Prentis’ three election opponents (Roger Bannister, John Burgess and Heather Wakefield) and their supporters along with a detailed discussion of what London regional staff can do to bolster the Prentis campaign in the days running up to the start of the postal ballot on 9 November. There is also an explicit warning not to get “caught out”, while mention of the union’s election rules provokes widespread laughter.

The public were first made aware of the Team Dave campaign emails when an article appeared in Private Eye in early February.

“Leaked emails reach the Eye providing more evidence that full-time staff of Unison mobilised to get general secretary Dave Prentis re-elected in December making the union’s claim to be a “member-led” look increasingly questionable.”

And

“The emails passed to the Eye from within the Prentis campaign indicate that Unison officials were in fact the backbone of “Team Dave”. The emails were sent by assistant general secretary Cliff Williams in October and November. The bulk of the recipients were other Unison officials – a rough count shows 45 of 50 addresses are regional secretaries, head office staff and other unison staff.”

 “One striking “Team Dave” note says: “it may be in some circumstance you may be able to ‘circumvent’ hostile branches by working with sympathetic employer contacts. I acknowledge that some colleagues may feel this is ethically inappropriate but it doesn’t breach campaign rules; it will have to be done with caution.”
It may not break campaign rules, but it still doesn’t look good. Similarly, having Unison officials lead the Prentis campaign doesn’t match the spirit of the union being “member led”.

The third extract above is in our view one of the most damming, especially for those grassroots reps and members who have been fighting employers who are sacking, privatising or cutting the Terms and Conditions of our members. The idea that union paid unelected officials would go behind the backs of locally elected branch officials is appalling and has no place in a trade union. To date there has been no condemnation of these remarks or any investigation.

 Repeated calls for an independent investigation were turned down.

The “Team Dave” emails provide a context to the content of the audio tape of the meeting in London on 21 October 2015.

#Unisongate Burgess and Ors. v UNISON Complaint 4


Dear UNISON members and all trade union members.

As the the date of the three day hearing approaches, people are asking: 

1. "What is #Unisongate and what are you complaining about? 

2. "Can members of the public attend the hearing?"

Complaint 4
During a meeting which took place on 16 September 2015, UNISON breached paragraph 51 of the General Secretary 2015 Election Procedures which are made under rules D7 and E3.3 and paragraph 7 of Schedule C to the UNISON rule book. This meeting took place between 0900 and 1200 at the University of London Union. This meeting was a conference for all Regional Staff and was called for and chaired by Linda Perks, the Regional Secretary of London Region. The UNISON General Secretary election was discussed at this meeting. Linda Perks allegedly stated at this meeting that Dave Prentis was the only credible candidate for General Secretary and allegedly sought to influence her staff to secure nominations for Dave Prentis. Both this meeting itself, and the discussion/statement made by Linda Perks, amount to the use of UNISON funds, resources and property to campaign for Dave Prentis.

Complaint 3

On or about 21 October 2015 to on or about 18 February 2016, UNISON breached section 49(6) of the Trade Union and Labour Relations (Consolidation) Act 1992 in that it failed to ensure that the Scrutineer duly carried out his functions and that there was no interference with his carrying out of those functions which would make it reasonable for any person to call the Scrutineer's independence in relation to the union into question. This is evidenced by the following:-

1. The Scrutineer/ Electoral Reform Society did not independently investigate and respond to the complaints that were made to it in relation to the General Secretary 2015 Election in accordance with the terms of reference of the election timetable and procedure. Specifically with reference to the complaints arising from the disclosure of the audio tape of the meeting held on 21 October in the UNISON Greater London Regional Office.

2. The ERS issued guidance on 21 October that informed branches and nominating bodies they could now inform their members why they had chosen to make a particular nomination. This guidance was issued after an email from Team Dave, dated 15 October 2015, which informed UNISON branches that they could publish the fact of their nomination together with the reason why. Prior to the issuing of the guidance by the ERS it was established procedure and known throughout the union that branches could only inform their members who the branch had nominated and not why. In any event the new guidance was not endorsed by the NEC as required by rule.

3. The Returning Officer, Alex Lonie, was sent Team Dave emails in January 2016. Mr Lonie neglected to refer to them in his official Returning Officer report published on 18 February.

4. The ERS was asked by Private Eye magazine about the Team Dave emails and their investigation at a time before the report was published and at a time when the ERS should have been conducting an independent investigation. In its response, the ERS informed Private Eye - "UNISON is preparing a report for Mr Lonie which would enable him to decide if the election was properly conducted. UNISON would then in turn report his decision back to its members."
